GLOBAL SYSTEM WARRANTY TERMS AND CONDITIONS

§1 General warranty conditions

  1. Global System Sp. z o.o. provides a 12-months warranty on all products1.
  2. The warranty applies to the products of Global System Sp. z o.o. - purchased and installed in UE.
  3. The warranty covers delivery, sale (in the case of purchase with installation service) and installation of products and is valid from the moment of signing the protocol of technical acceptance, or the packing list document confirming the release of goods to the Customer, but no longer than 14 months from the date of the invoice.
  4. The warranty entitles you to free removal of defects that occur during the warranty period, and which are caused by design, manufacturing defects.
  5. The claim should be filed immediately (no later than 3 days) after the discovery of the defect, otherwise the warranty rights are lost. In sales between entrepreneurs, the buyer loses warranty rights if he did not inspect the item at the time of delivery, before installing the product, and did not report the defect immediately. Use of the defective product is prohibited.
  6. Claims are accepted only through the application form on the website https://reklamacje.globalsystem.com.pl/en/, and will be processed on working days from 7:00 am to 3:00 pm.
  7. It’s possible to extend the warranty period up to 60 months subject to the signing of service agreement2.
  8. During the period of warranty repairs, the Buyer/User is obliged to:
    a) to make available, if necessary, the electricity necessary to carry out the work;
    b) to make available the work front, as well as equipment, i.e., a lift/scaffolding/elevator to enable the work to be carried out safely and in compliance with the law above 3 meters from the floor.
  9.  Global System Sp. z o.o. reserves the right to withhold warranty repairs if the Customer/User is in arrears with payments of any kind for more than 5 days from the invoice payment due date.

§2 Conditions for maintaining the warranty benefit

The basis for making claims under the guarantee is the following:

  1. A properly and completely filled out warranty card for the device.
  2. To carry out paid warranty inspections by the Seller or an entity recommended by the Seller min. every 6 months during the 12-month warranty period from the date of purchasing. Frequency of inspections after the warranty period min. every 12 months.
  3. Providing an inspection report immediately after execution – applies to dealer sales.

§3 Terms and conditions for extending the warranty protection benefit

  1. The warranty may be extended at the request of the Buyer/User. The terms of the extension will be specified in a separate service agreement.
  2. In the case of replacement of a component with a new one, the warranty period of this part runs anew, from the moment of delivery of a defect-free item.

§4 Loss of warranty benefit

Global System Sp. z o.o. is relieved of the warranty and all obligations in case of:

  1. Mechanical damage resulting from improper operation.
  2. Normal wear and tear of the goods.
  3. Lack of recommended maintenance.
  4. Use of the product contrary to the operating and safety instructions.
  5. Damage resulting from surges and voltage drops in the power grid.
  6. Damage resulting from the subsequent commissioning of equipment on permanent power by third parties, where the installation took place on temporary current.
  7. Improper electrical installation and type of power supply.
  8. Disconnecting or making changes to the cycle counter in a gate with a declared self-closing class higher than C0.
  9. To make repairs, modifications to the goods, structural changes by the user himself.
  10. Use of spare parts other than the original parts without the written consent of Global System Sp. z o.o.
  11. Installation, service and commissioning of products by persons who do not hold a current certificate of installation authorization and service authorization issued by Global System Sp. z o.o.
  12. The action of external factors such as: corrosion and discoloration (work in aggressive chemical environment), abnormal weather conditions, natural disasters and other fortuitous events arising through no fault of Global System Sp. z o.o.
  13. Lack of proper maintenance and operation of goods.
  14. Transportation and storage of goods not in accordance with the maintenance and operational instruction of the product.

§5 Other

  1. The warranty for paint coatings is 12 months.
  2. The occurrence on galvanized elements of the so-called "white corrosion" is not a basis for complaint.
  3. Products operated in a highly aggressive environment (e.g. closer than 500 m to the coastline of the sea, etc.) are excluded from the anti-corrosion warranty.
  4. The warranty does not cover consumable parts and parts subject to normal wear and tear: batteries, seals, cables, running components, bearings, among others.
  5. Components made of galvanized sheet are not subject to warranty in terms of surface aesthetics, especially regarding discoloration, surface scratches and abrasions. Galvanized sheet, due to its manufacturing characteristics and the use of zinc coating, may show irregularities in appearance, which do not affect its technical or functional properties. These features are characteristic of this type of material and do not provide any basis for warranty claims.
  6. Superficial discoloration on the coat and protruding threads from the material do not affect the properties, are not a defect and are due to the production process of the material. They do not reduce the usable properties of the product and are not grounds for complaint.
  7. Due to the specific nature of the industrial painting process and the variability of production conditions, differences in the colour shades of the sheets are acceptable, even within a single batch and with the same colour designation according to the RAL palette. These differences do not constitute a product defect and are typical for coatings obtained using industrial paints.
  8. Water remaining on the membrane does not constitute grounds for a complaint – a water drainage system can be used.
  9. Global System shall not be liable for damages resulting from the use of a defective or damaged product.
  10. "Working days" shall be understood as days from Monday to Friday excluding statutory holidays and public holidays.
  11. In the case of an unsubstantiated report, the Customer/User shall bear the lump-sum cost of the service team's travel and working hours for each service technician.
  12.  Submitting a complaint is equivalent to agreeing to charge the aforementioned Entity with the costs defined in Section. 10 paragraph 5.
  13. Under the warranty, neither the Customer/User nor any third parties shall be entitled to any claims for compensation against Global System Sp. z o.o. arising from failure of products sold and installed by Global System Sp. z o.o. The obligation of Global System Sp. z o.o.. is only to provide spare parts or repair the product.
  14.  The reasonableness of the application and the manner of repairs carried out shall be decided by Global System Sp. z o.o.
  15. The Guarantor shall not be obliged to upgrade or modify existing products after their newer versions enter the market.
  16. If the advertised product requires an expert examination, after which it will be determined that the product is in working order or the damage was not covered by the warranty Global System Sp. z o.o. reserves the right to charge the Customer/User for the cost of the above-mentioned examination.
  17. Replaced defective components under warranty shall become the property of Global System.
  18. In the event of a fire incident in a facility, even if the gate was not directly exposed to fire or smoke, the manufacturer should be notified immediately for servicing. This will allow for an assessment of the impact of the incident on the gate's technical condition and will confirm its continued operability and safety.
  19. In connection with the granting of the guarantee, the parties agree to exclude the liability of Global System Sp. z o.o. under the warranty, except when the buyer is a consumer.
  20.  In matters not regulated, the regulations of the Civil Code will apply.
